What it is, who it concerns and since when it applies.
What applies under EU law?
EUDR is Regulation (EU) 2023/1115 on deforestation. Anyone who places on the Union market, or exports from it, wood, paper, soya, coffee, cocoa, rubber, palm oil or cattle and products made from them listed in Annex I to the regulation must demonstrate due diligence: geolocation of the plots, evidence of legality and a due diligence statement. An FSC certificate does not mean automatic compliance: the regulation accepts it as input to the risk assessment (Art. 10(2)(n)), but responsibility for due diligence remains with the company.
Who does it concern?
Commodity importers, paper mills and wood processors, furniture manufacturers and traders. The regulation covers placing and making available on the Union market, not only imports from third countries: even if you buy from a Czech or Slovak supplier and further supply Annex I goods on the market or make other Annex I products from them, you are usually a downstream operator or trader with your own record-keeping obligations. What counts is the country of production of the commodity, not the country the goods come from.
Since when does it apply?
The deadline has moved to 30 December 2026. The postponement to 30 June 2027 applies only to operators that are natural persons, micro-enterprises or small enterprises established by 31 December 2024 (not to downstream operators or traders, regardless of size), and it does not apply to wood and wood products listed in the annex to the EUTR Regulation (Regulation (EU) No 995/2010) – for example sawn timber, boards, pallets, paper and wooden furniture of heading 9403: a small sawmill or joinery with such products starts on 30 December 2026. Annex I was amended from 18 September 2026 by Commission Delegated Regulation (EU) 2026/2102 (it removed, for example, hides and leather of cattle; instant coffee is added only from 30 December 2027).
Slovakia: who supervises?
Implementation of EUDR in Slovakia is governed by Act No. 81/2025 Coll. The competent authority under Art. 14 EUDR is the Slovak Forestry and Timber Inspectorate in Zvolen (SLDI) (Section 6(4)(a)): it carries out state supervision, determines high risk, imposes interim and corrective measures and decides on administrative offences at first instance; the Ministry of Agriculture and Rural Development of the Slovak Republic (MPRV SR) directs enforcement, decides at second instance and fulfils notification duties towards the Commission (Sections 4 and 5). Amendment No. 416/2025 Coll. moved the effective date of the part of the Act concerning EUDR to 30 December 2026, in line with the postponement of the regulation; until then only the earlier rules (EUTR) apply. Administrative offences (Section 14) distinguish between large enterprises and SMEs.
What are the risks?
Penalties are set by Member States, but the regulation gives them a minimum: the maximum fine for a legal person must be at least 4% of total annual turnover in the Union, plus confiscation of the products and revenues from them, exclusion from public procurement and public funding for up to 12 months and, for serious or repeated breaches, a temporary ban on placing products on the market (Art. 25(2)). In Slovakia, administrative offences are governed by Section 14 of Act No. 81/2025 Coll. Without plot geolocation from the supplier, the due diligence statement cannot be submitted at all, and obtaining it at the last minute is too late.
What can go wrong
- Small sawmills, joineries and wooden furniture manufacturers have no postponement to 2027 for wood and products listed in the annex to the EUTR Regulation – they start on 30 December 2026
- Without plot geolocation from the supplier the statement cannot be submitted, and obtaining it at the last minute is too late
- The list of products in Annex I is changing: from 18 September 2026 Delegated Regulation (EU) 2026/2102 removed, among others, hides and leather; from 30 December 2027 instant coffee and further palm oil derivatives are added – the product range needs to be monitored continuously
- Slovakia: administrative offences under Section 14 of Act No. 81/2025 Coll.; throughout the Union, the maximum fine for a legal person must be at least 4% of turnover (Art. 25(2))
