What it is, who it concerns and since when it applies.
What applies under EU law?
GPSR is the General Product Safety Regulation, Regulation (EU) 2023/988. It applies directly throughout the EU and only safe non-food consumer products may be placed on the market (Art. 5). It sets obligations for manufacturers, importers, distributors and online shops: the manufacturer carries out an internal risk analysis and keeps technical documentation, product information and safety information must be on the product and in the online offer, accidents are reported by the manufacturer, and products of manufacturers outside the EU need a responsible person in the Union.
Who does it concern?
Practically every online shop and seller of consumer goods, importers and manufacturers. The scope of obligations depends on the role in the chain: seller, importer or de facto manufacturer, for example when selling under your own brand. A product may be placed on the EU market only if there is an economic operator established in the EU who is responsible for it (Art. 16) – this concerns mainly goods imported from outside the EU. Platforms such as Amazon or Shoptet help with forms, but responsibility for the accuracy of the information and the obligations in the event of accidents remains with the seller.
Since when does it apply?
The regulation applies from 13 December 2024. Products placed on the market earlier in accordance with the previous directive may still be supplied (Art. 51), but according to the Commission’s non-binding guidance, GPSR obligations apply to every offer made from 13 December 2024. Accidents are reported by the manufacturer via the Safety Business Gateway without undue delay (Art. 20); the internal risk analysis and technical documentation are kept for 10 years.
Czech Republic: what applies nationally?
The amount of fines is set by Czech Act No. 387/2024 Coll.: up to CZK 50 million for manufacturers and importers for the most serious offence, and up to CZK 5 million for missing information in the online offer. Supervision is carried out by eleven authorities led by the Czech Trade Inspection Authority (ČOI).
Slovakia: what applies nationally?
Implementation in Slovakia is governed by Act No. 83/2025 Coll., in force from 1 May 2025. Instructions for use and safety information, where they are provided with the product, must be in Slovak (Section 2(4)); in distance selling aimed at consumers in Slovakia, warnings and safety information must be in Slovak already in the offer (Section 2(6)). Supervision is carried out by the Slovak Trade Inspection (SOI) (Section 4).
What are the risks?
A product of a manufacturer outside the EU cannot be placed on the market without a responsible person established in the EU, and an offer without the mandatory information is a breach in itself, even if the goods are safe. GPSR itself does not set the amount of fines (Art. 44) – national law does: in the Czech Republic up to CZK 50 million (Act No. 387/2024 Coll.), in Slovakia up to €50,000 for breaches of the obligations of the manufacturer (Art. 9), importer (Art. 11) and distributor (Art. 12) (Section 9 of Act No. 83/2025 Coll.).
What can go wrong
- Products of a manufacturer outside the EU cannot be placed on the market without a responsible person established in the EU – if you import them yourself, that person is you, as the importer
- An offer without the mandatory product information is a breach in itself – even if the goods are safe
- An accident must be reported without undue delay; whoever waits for a lawyer is already late
- Czech Republic: a fine of up to CZK 5 million for missing information in the online offer (Act No. 387/2024 Coll.)
- Slovakia: an online offer without the mandatory information on the manufacturer and the product and without safety information in Slovak (Art. 19; Section 2(6) of Act No. 83/2025 Coll.) – with a fine of up to €50,000 from the Slovak Trade Inspection (SOI) (Section 9)
