What is the Right to Repair?
The Right to Repair (R2R) is Directive (EU) 2024/1799. Manufacturers of selected goods (washing machines, dishwashers, fridges, vacuum cleaners, phones, tablets) are to repair the product at the consumer’s request even after the warranty, at a reasonable price and within a reasonable time. The directive is fully harmonising, so the content of the EU obligations is already known.
Who does it concern?
The obligation to repair lies primarily with the manufacturer and, in cascade, with the authorised representative, the importer and the distributor; for goods of a manufacturer outside the EU with no representative and no importer it may fall on the online shop. Anyone who places goods from a third country on the EU market themselves is an importer, and anyone who sells appliances subject to mandatory repair under their own brand is a manufacturer. The rules on complaints also change for every seller.
Since when does it apply?
Slovakia: since 31 July 2026 (Art. V of Act No. 310/2025 Coll.), exactly on the date of application under Art. 3 of the directive; contracts concluded before 31 July 2026 are governed by the previous law (Section 879aa of the Slovak Civil Code). Czech Republic: as at 30 September 2026 it does not apply. The EU transposition deadline expired on 31 July 2026, but the directive itself does not impose obligations on companies. Both Czech acts (parliamentary prints 53 and 62) passed second reading on 24 June 2026, MPs received the guarantee committee’s opinion on 4 September 2026, and third reading, the Senate, the President and promulgation are still ahead; entry into force may therefore come within months.
Czech Republic: what is proposed?
Under the Czech draft, liability for defects is to be 3 years after the repair of a claimed defect, for all consumer goods – not only for the listed categories – for contracts concluded from the entry into force of the new rules. Under the Czech draft you will also have to inform the customer of the extended liability as early as when the claim is made, not only when it is settled. The specific figures that the Chamber of Deputies sets itself (length of liability after a repair, the level of fines) are so far only a draft. For the Czech Republic we therefore offer preparation, not a compliance check: thanks to full harmonisation the content of the EU obligations is given, so everything can be prepared calmly rather than under pressure after promulgation.
Slovakia: what does the Slovak act require from manufacturers and repairers?
Act No. 310/2025 Coll. transposes the directive: Section 13b of Act No. 108/2024 Coll. obliges the manufacturer to repair goods at the consumer’s request even beyond liability for defects, if repairability requirements under Annex II of the directive apply to them (for example washing machines, dishwashers, fridges, displays, vacuum cleaners, servers, mobile phones, tablets, tumble dryers and, from 18 February 2027, goods with a built-in battery of a light means of transport), free of charge or for a reasonable price and within a reasonable time. Repairers provide, on request, without delay and free of charge, the European Repair Information Form (Section 13a, Annex 3a), whose terms bind them for at least 30 days.
Slovakia: what changes for sellers?
After the first repair within liability for defects, the liability period is extended by 12 months, only once (Section 619(4) of the Slovak Civil Code). Repair or replacement must be carried out within 30 days of notification of the defect at the latest, unless a longer period is objectively justified; the burden of proof lies with the seller (Section 623(4)). The seller informs the buyer of the right to choose between repair and replacement (Section 623(2)).
What can go wrong
- If you sell goods of a manufacturer outside the EU with no representative and no importer, the obligation to repair may fall on you.
- Czech Republic: the complaints procedure and forms will have to be adapted before the act takes effect.
- Czech Republic: under the Czech draft you will have to inform the customer of the extended liability as early as when the claim is made, not only when it is settled.
- Slovakia: the complaints procedure, forms and website information must comply with the new rules now – the act has been effective since 31 July 2026.
- Slovakia: repair or replacement within 30 days – you must be able to justify a longer period objectively, and the burden of proof is on you (Section 623(4) of the Civil Code).
