What it is, who it concerns and since when it applies.
What is the EAA?
The EAA is the European Accessibility Act, Directive (EU) 2019/882. Online shops and digital services for consumers must be perceivable, operable, understandable and robust. WCAG and EN 301 549 are not in the text of the Czech act; they are the established practical standard for measuring compliance, but they do not yet give a presumption of conformity. In the Czech Republic the directive is transposed by Act No. 424/2023 Coll.; in Slovakia by Act No. 351/2022 Coll. for services (in force since 28 June 2025) and by Government Regulation No. 89/2026 Coll. for products.
Since when does it apply?
Czech Republic: the act has applied since 28 June 2025, also to online shops that have been running for years. Transitional rules up to 2030 concern contracts concluded before that date (until they expire) and devices used before, for self-service terminals up to 20 years. They do not apply to the online shop itself: each new order is a new contract. Slovakia: a service provided under a contract concluded by 28 June 2025 is not subject to the requirements until the contract ends, at the latest until 28 June 2030 (Section 12).
Czech Republic: who is in scope?
Consumer services: online shops and online ordering including their mobile apps, banking and payment services, e-books, transport and booking systems; a purely B2B online shop is not covered. A microenterprise providing services – fewer than 10 employees and turnover or balance sheet total up to €2 million – is excluded; size is counted for the whole group and the exemption must be provable. Others can only rely on the exemptions for fundamental alteration or disproportionate burden, with a documented assessment and prior notification to ČOI.
Slovakia: services
Providers of services to consumers: information society services including online shops, passenger transport, financial services and e-books (Section 2(1) of Act No. 351/2022 Coll.). The act does NOT apply to a microenterprise providing services (Section 2(3)).
Slovakia: products
Designated products under Government Regulation No. 89/2026 Coll.: consumer computer hardware and operating systems, self-service terminals (payment terminals, ATMs, ticket machines…), terminal equipment for electronic communications and audiovisual media, e-readers. Note: a microenterprise MANUFACTURER is NOT exempt (unlike services) – it only has relief on documentation.
What is at stake?
Czech Republic: a fine from ČOI of up to CZK 10 million and publication in the list of non-compliant services. Missing accessibility information in the terms and conditions is a separate offence with a fine of up to CZK 1 million (Section 25(7)(d)), even if the website is in order. Slovakia: for breaching the accessibility requirements for services, fines from €200 up to 3% of turnover, at most €6,000 / €20,000 / €30,000 depending on the type of breach (Section 10 of Act No. 351/2022 Coll.). The fine is waived if you remedy the situation or demonstrate a disproportionate burden. Supervision is carried out by the Slovak Trade Inspection (SOI).
What can go wrong
- A barrier in the basket or at payment means a lost order from a customer who cannot get past it.
- Czech Republic: a missing accessibility statement in the terms and conditions is a breach in itself, even if the website is in order.
- Czech Republic: an overlay widget does not remove barriers – the supervisory authority assesses actual operability, not an installed script.
- Slovakia: a designated product (terminal, e-reader, terminal equipment) without a conformity assessment, EU declaration of conformity and CE marking (Government Regulation No. 89/2026 Coll., Act No. 56/2018 Coll.).
- Slovakia: fines from €200 up to 3% of turnover – for an inaccessible service at most €6,000, for other breaches at most €20,000, for failure to cooperate at most €30,000 (Section 10); supervision by the Slovak Trade Inspection (SOI).

- Conformity assessment + technical documentation, EU declaration of conformity (Section 23) and CE marking (Section 25) – Act No. 56/2018 Coll.
- Relief for a microenterprise manufacturer: only for documenting the assessment of disproportionate burden (Section 14 of Government Regulation No. 89/2026 Coll.)
- Supervision: Slovak Trade Inspection (SOI) (services Section 8; products Section 9 in conjunction with Section 26 of Act No. 56/2018 Coll.)
