Obligations do not end with registering as a producer of packaging. One of the most frequently overlooked tasks recurs every year: keeping records of packaging and submitting a report to the ministry by 28 February. This article explains who submits the report, by when, how the procedure differs between collective and individual fulfilment and what applies for 2026.
What the records and the report are
A producer of packaging must keep and retain records of packaging and report data from them to the ministry (Section 27(4)(h) of Act No. 79/2015 Coll.). Records are kept for five years. The report summarises the data from the records for a calendar year and is the basis for meeting the collection and recycling targets under the act.
Deadline: by 28 February
The report on the data from the packaging records for a calendar year is submitted by 28 February of the following year. The deadline is binding and applies to every calendar year in which you placed packaging on the Slovak market.
Who submits the report: individually or through a PRO
The report is submitted by a producer fulfilling its reserved obligations individually and by the PRO for the producers it represents. A producer fulfilling its obligations collectively through a PRO does not submit the report itself, but must provide the PRO with true and complete data and substantiate them within 30 days on request (Section 27(12)). It also applies to small quantities below 100 kg
A producer that places in total less than 100 kg of packaging on the Slovak market in a year is not subject to obligations such as the contract with a PRO or the collection and recycling targets (Section 54(6)). The relief does not cover records and the report: such a producer must still keep records and submit the report by 28 February (expressly Section 15(6) of Decree No. 366/2015 Coll., from 1 January 2027 Section 11(5) of Decree No. 89/2024 Coll.).
For 2026 still under the previous rules
Until 31 December 2026 the procedure follows Decree No. 366/2015 Coll. Electronic reporting through the information system under Decree No. 89/2024 Coll. applies only from 1 January 2027 (postponed by Decree No. 369/2025 Coll.), so the report for 2026 is still submitted under the previous rules (Section 19(2) of Decree No. 89/2024 Coll.).
What you risk if you fail to comply
Breach of the record-keeping and reporting obligation under Section 27(4)(h) is an administrative offence punishable by a fine of €500 to €50,000 (Section 117(1) of Act No. 79/2015 Coll.). Supervision is carried out by the Slovak Environmental Inspectorate.
