NĚMECKO (národní vrstva, VerpackG) - KDO JE POVINNÝ U DODÁVEK ZE ZAHRANIČÍ: Povinnosti podle německého zákona o obalech (registrace v LUCID, systémová účast) nese u zboží dováženého do Německa ten, kdo za balené zboží nese právní odpovědnost v okamžiku přechodu hranice, tedy nese riziko ztráty či poškození zboží při přepravě a odpovídá za celní odbavení; okamžik převodu vlastnictví rozhodující není. Kdo odpovědnost nese, si mají strany smluvně dohodnout před uvedením zboží na německý trh; vodítkem jsou Incoterms: při dodací podmínce EXW (výrobní závod v zahraničí) nese odpovědnost při přechodu hranice VŽDY kupující; při DAP s místem dodání v Německu a dodávce zajišťované zahraničním prodávajícím ji OBVYKLE nese prodávající. Při přímém zasílání soukromým konečným spotřebitelům lze obvykle předpokládat, že odpovědnost nese zahraniční firma.
